Drift Creative Systems – Website Terms of Use

1. About these terms

1.1 These terms apply to your use of driftcreativesystems.co.uk (the site). By using the site, you agree to them. If you don’t agree, please don’t use the site.

1.2 The site is run by Drift Creative Systems, a trading name of [legal entity name], registered in England and Wales under company number [number], at [registered address]. In these terms, “we”, “us” and “our” mean that company.

1.3 These terms only cover the website. If you sign up for one of our apps, that app’s own terms apply to it, together with any order or proposal you accept:

  • Drift: Surface and Drift Hub: Terms of Service
  • Other Drift apps: each app links to its own terms when it launches

1.4 How we use your personal data is explained in our Privacy Policy.

2. Using the site

2.1 The site is free to use. We try to keep it available and accurate, but we don’t guarantee it will always be available, uninterrupted or error-free. We may change, suspend or remove any part of it without notice.

2.2 The information on the site is general information about Drift and our apps. It isn’t professional advice, and it isn’t an offer to supply anything.

2.3 Apps in development. Several apps are shown as “In development” or “Coming soon”. Their features, prices and launch dates may change, and some may never launch. Registering interest doesn’t commit you or us to anything.

2.4 Prices. Prices shown on the site exclude VAT unless we say otherwise. They’re a guide; the price you pay is the one in the order or proposal you accept.

2.5 Examples and demos. Screenshots, sample artists, sample gig listings and demo content are illustrative. Any resemblance to real bands or venues is accidental unless we name them as a client.

3. Our content and your use of it

3.1 We own, or have permission to use, everything on the site: text, designs, logos, screenshots, graphics and code. “Drift”, “Drift Creative Systems” and the names of our apps are our brands.

3.2 You can view, print and share pages from the site for your own information, or to recommend us to someone. You can’t copy, adapt or republish our content or designs, or use our names and logos to suggest a link with us, without our written permission.

3.3 Code we publish on GitHub is covered by the licence in each repository, not by these terms.

4. Acceptable use

You must not:

  • use the site in a way that breaks the law or harms anyone;
  • send us spam, malicious code, or anything abusive through our forms;
  • try to gain unauthorised access to the site, its server or any connected system, or disrupt them;
  • scrape or harvest content or contact details from the site by automated means.

5.1 The site links to other websites, such as GitHub, example artist sites and our support desk. We aren’t responsible for websites we don’t run.

5.2 You’re welcome to link to our home page or app pages, as long as it’s fair and doesn’t suggest we endorse you without our agreement.

6. Our liability

6.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow us to limit.

6.2 The site is provided free of charge and as it is. As far as the law allows, we aren’t liable for any loss caused by using, or being unable to use, the site or anything on it, or by relying on its content. This includes loss of profit, business or data, and indirect or consequential loss.

6.3 We take care to keep the site secure, but we can’t guarantee it’s free of viruses. Please use your own virus protection.

6.4 If you’re a client, our liability for the app you use is set out in that app’s terms, not here.

7. Changes to these terms

We may update these terms from time to time by changing this page. The date at the top shows when they last changed. Please check back occasionally.

8. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
